The fellow is Associate Professor Amy Maguire, based at the University of Newcastle School of Law and Justice, and the industry partner is the Australian Human Rights Commission.
The fellowship is funded for four years, commencing in February 2025, and the PhD candidature will be undertaken concurrently with the fellowship term (completion year 2028).The Australian Human Rights Commission has recommended passage of a national Human Rights Act that includes a 'participation duty' for public authorities.
Such a duty would require the effective participation of people from specified groups, namely First Nations peoples, children and young people, and people with disability, in decision-making processes that affect them.This PhD project will complement the fellowship project by building new knowledge regarding effective human rights law reform and implementation in Australia.
The PhD candidate will evaluate pathways to actualising a participation duty in Australian human rights law.
This study will require doctrinal, comparative and qualitative research and will build the candidate's expertise in international and Australian human rights law, law reform, and the connections between research and policy-making.
The candidate will have the opportunity to collaborate with the Australian Human Rights Commission in an industry-engaged PhD project that promises excellent skill development and policy translation potential.Application details:Application Link
