This role involves overseeing the strategic management of investigations and litigation involving alleged contraventions of the Corporations Act, the ASIC Act and Market Integrity Rules. The team
Markets Enforcement is part of the Markets Group, responsible for taking enforcement action on matters such as continuous disclosure, insider trading and market manipulation.
Markets Enforcement investigates suspected market misconduct and takes formal enforcement action in response to suspected breaches of the Corporations Act, ASIC Act and Market Integrity Rules. This includes oversight of civil proceedings in conjunction with our in-house legal services team or external lawyers and counsel, working with the Commonwealth Director of Public Prosecutions (CDPP) to secure criminal convictions and taking administrative action through the Market Disciplinary Panel. Working at the forefront of regulatory enforcement, you will report to the Senior Executive Leader.
The Markets Enforcement team is focused on market integrity and maintaining and improving the cleanliness of our financial markets. We investigate listed entities for failing to disclose material information to the market as well as investigating insider trading and market manipulation. We have recently set up an Insider Trading Team focused on increasing the number of insider trading investigations we complete in order to increase referrals to the CDPP for prosecution. We are a multi-disciplinary team, comprising lawyers and investigators with diverse skills and experience.
The role
As a Senior Specialist, you will lead complex investigations and drive enforcement action on serious market misconduct. Working within Markets Enforcement, you will play a key role in:
1. Overseeing high-profile investigations and litigation to deliver strong enforcement outcomes.
2. Providing strategic guidance on case scope, risk assessment, litigation and investigative approaches.
3. Challenging case theories to strengthen evidence and improve enforcement strategies.
4. Mentoring and developing teams, fostering a culture of innovation and excellence.
5. Driving improvements in investigative processes, leveraging technology and data analytics.
6. Building and maintaining internal and external relationships including law enforcement bodies and regulatory agencies.
About you
You are a highly skilled litigator with significant experience managing complex civil and criminal litigation, particularly in the context of market misconduct and enforcement. Your expertise includes leading high-profile investigations, navigating legal complexities, and delivering successful litigation outcomes. You have a proven track record in managing risk, devising strategic litigation approaches, and ensuring the effective enforcement of laws promoting market integrity.
You are a strong leader with excellent communication skills, able to guide and support teams effectively. You collaborate well with internal teams and external stakeholders, including regulatory bodies and law enforcement agencies. You think critically, challenge assumptions, and look for ways to improve processes. With sound judgement and problem-solving abilities, you manage risk and find effective solutions. You are proactive in driving improvements and fostering a culture of continuous improvement in your team.
