The Role The role of Medico-legal Adviser exists to provide medico-legal advice, support and risk management services to Members of MDA National. The key function of the role is the provision of prompt, accurate and empathic medico-legal advice and assistance to Members, including health practitioners and practice staff. We are particularly interested in someone who is comfortable with public speaking/presentations as well as writing articles/blogs etc for our members. The responsibilities for this role will include (but not be limited to) the following: The provision of high-quality medico-legal advice. Participation in the medico-legal phone roster, and responding to other contact (online notifications, emails etc.) from Members seeking medico-legal advice on a wide range of matters, including but not limited to: subpoenas to give evidence, subpoenas for medical records, and court-related queries letters from solicitors and requests for compensation ethical dilemmas and challenging patient interactions ending care consent billing queries and Medicare audits family disputes and deceased estates privacy and confidentiality matters involving the Police and other law enforcement agencies communication from a range of statutory bodies including the Office of the Australian Information Commissioner (OAIC), the Department of Health and Aged Care (DHAC), the Australian Health Practitioner Regulation Agency (AHPRA) and other stated-based health bodies medical records practice management queries employment disputes writing medico-legal reports and completing forms/certificates patients’ fitness to drive/fly/own a firearm mandatory reporting of health practitioners to AHPRA mandatory reporting of child abuse and child protection requests medical registration issues. Provision of medico-legal advice and support to the broader Cases and Advisory Service team, and other staff within MDA National. The day-to-day management of Members’ advice, including the review of draft responses to complaints and other investigations. Contribute regularly to presentations and publications, in accordance with the Business Plan and the needs of the organisation. Participate in various committees, projects and working groups within the organisation. Risk management support, including: identification and management of risk management issues assist in the identification of high-risk Members liaise with Support in Practice and Underwriting when necessary. Participate in the urgent after-hours call roster, as required. Medically qualified staff will also, in addition to the above: provide a medical review of files to assist Cases and Advisory Services provide additional peer support to Members as part of our Doctors for Doctors Program. Skills & Experience The ideal candidate will have the following: Appropriate clinical or legal qualifications qualification/experience which includes exposure to common medico-legal issues and an understanding of the medical indemnity industry. A high level of health literacy is essential Exposure to or experience in dealing with medicolegal issues Excellent interpersonal skills, including the ability to relate to a wide range of people including colleagues across the business, the Executive, Board and Council, MDA Member in times of high stress and a variety of health stakeholders. A superior level of oral and written communication, including confident public speaking/presentation skills, experience in writing for business, and writing for publications (articles, blogs etc.).
